This is an English translation provided for convenience. The Polish version of these Terms is legally binding.
§ 1. General provisions
- The owner of the online shop and the service provider is SOUL SPA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at ul. Długa 39/8, 47-400 Racibórz, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS: 0001037216, NIP: 6392028685, REGON: 525397353, represented by Violetta Larysz.
- The Service Provider can be contacted by e-mail at violettalarysz@gmail.com and by phone at +48 601 949 906.
- These Terms set out the rules for using the shop, booking and purchasing Sessions and Consultations, both on-site and online.
- Only an adult with full legal capacity may be a Client.
- For online services a device with internet access, a working camera and microphone, and the Google Meet application are required. On-site services are provided at the Service Provider's practice.
§ 2. Types of services
The Service Provider sells the following on-site and online services through the website:
- Individual session (on-site or online) - a meeting within a long-term transformational and therapeutic process, based on holistic methods (including The Journey®, Gene Keys®).
- Gene Keys® consultation (online) - a meeting within a long-term transformational and therapeutic process, based on the Gene Keys® system.
§ 3. Purchase and booking rules
- Services are purchased through the order form (cart) on the website.
- Before making payment, the Client selects the meeting format (on-site or online) and an available date from the interactive calendar on the website.
- The contract is deemed concluded upon the Client's successful payment. Order confirmation is sent automatically to the Client's e-mail address (for online services the message also contains a Google Meet link).
§ 4. Pricing and payment methods
- All prices shown on the website are final prices (gross).
- The Service Provider is exempt from value added tax (VAT) under applicable law (the stated prices do not include VAT).
- Online payments are handled by PayPro S.A., with its registered office in Poznań (61-037), ul. Pastelowa 8, KRS: 0000347935, NIP: 7792369887, REGON: 301345068 (operator of the Przelewy24 service).
- Within the Przelewy24 system the Client may pay by: instant online transfer, BLIK, payment card (Visa/Mastercard) or electronic wallets (Google Pay / Apple Pay).
- The Client is required to pay for the order immediately after placing it. Failure to authorise payment in the Przelewy24 system within 15 minutes results in automatic cancellation of the booking.
§ 5. Performance and cancellation of services
- The duration of a single Session/Consultation is, depending on the type, 75 min, 90 min, 60 min or 50 min respectively. The Client's lateness (for both online and on-site meetings) does not extend the meeting and is not grounds for a price reduction.
- The Client has the right to reschedule or cancel a visit free of charge no later than 24 hours before the scheduled meeting.
- Cancellation after this deadline, or the Client's absence from an on-site or online meeting, means the service is deemed performed - the fee paid is then non-refundable.
- If the service does not take place for reasons attributable to the Service Provider, the Client is entitled to choose another date or to an immediate refund of 100% of the funds paid, via the Przelewy24 payment channel.
§ 6. Right of withdrawal
- A Client who is a Consumer generally has the right to withdraw from a distance contract within 14 days without giving a reason.
- Exclusion of the right of withdrawal: pursuant to art. 38(1)(1) of the Consumer Rights Act, this right does not apply if the Service Provider has fully performed the service with the Consumer's express and prior consent, the Consumer having been informed before performance that, once it is completed, they will lose the right of withdrawal. This consent is expressed by the Client by ticking the appropriate box (checkbox) in the purchase process.
§ 7. Confidentiality and safety
- The Service Provider is obliged to keep in complete confidence all information obtained from the Client during Sessions and Consultations. Confidentiality may be lifted only in cases strictly provided for by Polish law (e.g. a direct threat to the life or health of the Client or others).
- Sessions constitute a complementary approach based on working with emotions and do not replace traditional medical or psychiatric treatment.
- Recording, audio/video capture, photographing or reproducing the course of Sessions and Consultations (both online and on-site) by either party (both the Client and the Service Provider) is strictly prohibited.
- The rules for processing personal data (GDPR) are set out in the "Privacy Policy" document available on the website.
§ 8. Complaints procedure
- Complaints regarding the services provided should be submitted electronically to: violettalarysz@gmail.com.
- A complaint will be considered within 14 days of receipt, and a reply will be sent to the Client's e-mail address.
§ 9. Final provisions
- These Terms enter into force on the date of their publication on the website.
- Matters not covered by these Terms are governed by the provisions of the Polish Civil Code and the Consumer Rights Act.
